In this essay I discuss an important but neglected controversy in which the Stoics sought to discredit Epicurus' teaching on justice by showing that the Epicurean wise man, if immune from detection or punishment, will commit injustice whenever he may profit from it. Under the influence of this criticism, tradition has developed a view of Epicurus' position that makes it so weak and vulnerable that it is difficult to see how Epicureans could have defended it over the course of several (...) centuries. There is decisive evidence, however, that Epicurus' critics seriously misrepresented his position, and that the tradition influenced by their polemic stands in need of fundamental revision.1 My purpose here is to prove that the Epicurean wise man will not commit injustice, secretly or openly, because it is in his self–interest to be just; to reconstruct Epicurus' arguments for this teaching; to show how he defends his position against natural right theorists; and to clarify the larger issues at stake in his controversy with the Stoics. What exactly are we conscious beings? Do we have immaterial souls, souls that are substances and can survive the destruction of our physical bodies? Richard Swinburne has recently given an affirmative answer to the latter question on the basis of a strikingly simple Cartesian argument. This paper shows why Swinburne’s argument ultimately fails, owing to an instructive dilemma concerning the logical possibility of conscious beings’ surviving bodily destruction. This study investigated faculty attitudes towards student violations of academic integrity in Canada using a qualitative review of 17 universities’ academic integrity/dishonesty policies combined with a quantitative survey of faculty members’ (N = 412) attitudes and behaviours around academic integrity and dishonesty. Results showed that 53.1% of survey respondents see academic dishonesty as a worsening problem at their institutions. Generally, they believe their respective institutional policies are sound in principle but fail in application. Two of the major factors identified by (...) faculty as contributing to academic dishonesty are administrative. Many faculty members feel unsupported by their administration and are reluctant to formally report academic dishonesty due to the excessive burdens of dealing with paperwork and providing proof. Faculty members also cite unprepared students and international students who struggle with language issues and the Canadian academic context as major contributors to academic dishonesty. This paper supports the personal data platform cooperative as a means of bringing about John Rawls’s favoured institutional realisation of a just society, the property-owning democracy. It describes personal data platform cooperatives and applies Rawls’s political philosophy to analyse the institutional forms of a just society in relation to the economic power deriving from aggregating personal data. It argues that a society involving a significant number of personal data platform cooperatives will be more suitable to realising Rawls’s principle of fair (...) equality of opportunity. (shrink)

When the absence of an event causes some outcome, it is an instance of omissive causation. For instance, not eating lunch may cause you to be hungry. Recent psychological proposals concur that the mind represents causal relations, including omissive causal relations, through mental simulation, but they disagree on the form of that simulation. One theory states that people represent omissive causes as force vectors; another states that omissions are representations of contrasting counterfactual simulations; a third argues that people think about (...) omissions by representing sets of iconic possibilities – mental models – in a piecemeal fashion. In this paper, we tease apart the empirical predictions of the three theories and describe experiments that run counter to two of them. Experiments 1 and 2 show that reasoners can infer temporal relations from omissive causes – a pattern that contravenes the force theory. Experiment 3 asked participants to list the possibilities consistent with an omissive cause – it found that they tended to list particular privileged possibilities first, most often, and faster than alternative possibilities. The pattern is consistent with the model theory, but inconsistent with the contrast hypothesis. We marshal the evidence and explain why it helps to solve a long-standing debate about how the mind represents omissions. (shrink)

Le thème du « nouveau » permet de consolider l’une des leçons que l’on peut tirer de l’œuvre de Ricœur : pour vivre ensemble, il faut vivre. Ideas of love within religion are usually driven by one of two mythologies – either a personal God who commands love or a mystical God of ineffable love – but both are inadequate for motivating love of neighbour. The first tends towards legalism and the second offers no cognitive guidance. The situation is further complicated by there being different understandings of love of neighbour in the various Abrahamic religions, as exemplified in the approaches of two philosophers, Søren Kierkegaard and Emmanuel (...) Levinas. A better approach is therefore to explore actual practices of love in everyday life, and to discover how love might be performed openly and creatively. One such practice is recognition of vulnerability, and this too is often driven by a mythology, in this case one marked by fear, and by a violence either imposed or avoided. One paradigmatic example is the vulnerability felt by speakers, especially women, in front of an audience. A turning from wilful ignorance of vulnerability and a turning to reliance on collective work, modelled on an awareness of mutual vulnerability and openness to the unknown, will help to change our philosophical and social imaginary. The dark myth of vulnerability can be transformed into finding opportunities in vulnerability for openness to affection and so to an enhancement of life. It is only from the perspective of this new imaginary, and from everyday practices of it, that the double love-command – love of God and love of neighbour – will function as any kind of common ground between religions. This article is a contribution to interdisciplinary scholarship addressing the presumption of innocence, especially interdisciplinary conversations between philosophers and jurists. Terminological confusion and methodological traps and errors notoriously beset academic literature addressing the presumption of innocence and related concepts, such as evidentiary presumptions, and the burden and standard of proof in criminal trials. This article is diagnostic, in the sense that its primary objective is to highlight the assumptions—in particular, the disciplinary assumptions—implicit in influential contributions to debates on the presumption (...) of innocence. It advocates a methodologically pluralistic approach, according to which definitions of the presumption of innocence are necessarily sensitive to purpose and method. These relationships and their implications are not always appreciated, and are seldom explicitly elucidated. Notably, philosophers routinely treat the presumption of innocence as epistemic, evidentiary or otherwise featuring directly in practical reasoning. This article identifies jurisprudential and practical reasons why legal scholars and practitioners concerned with criminal procedure and evidence should reject evidentiary interpretations of the presumption of innocence. By encouraging finer-grained engagement with the history and institutional details of common law procedural traditions, the article aims to show why legal scholars might think that philosophical approaches to the presumption of innocence are already methodologically-loaded and, for our purposes, address the wrong questions with deficient concepts. Computer programs are generating artworks of astonishing novelty and aesthetic value. By the standard definition of creativity, these programs would count as being creative. But if you still hesitate to call a program creative, that's for good reason, we argue. It's because real creativity requires AGENTS who are responsible for what they make, and it's not at all clear that these programs are agents. -/- (The title was imposed by the editor. It was supposed to be called, "ARE COMPUTERS CREATIVE?").

This essay considers the question of conversion unto repentance, as an act of cognition and volition, by the separated soul in the post‐mortem state. It primarily explicates and interrogates Thomas Aquinas's various attempts to rule out this possibility for the damned. Since Thomas's arguments for such impossibility feature his commitment to the radical immateriality of the human soul—and, like it, the angelic spirit—the essay highlights the ontological and moral tensions within that account. The case is thus made for the ontological, (...) logical, and moral inconsistencies of his position, in pursuit of a more holistic anthropology across the soul's various states and a more rationally and coherent eschatology—namely, an affirmation of the irreducible mutability of the created soul on its way towards likeness to God, perhaps, if not certainly, towards universal salvation. El objetivo de este artículo es abordar el reciente problema del nexo entre realismo y fenomenología hermenéutica desde un enfoque específico: el diálogo entre el nuevo realismo de Markus Gabriel y algunas propuestas hermenéutico-fenomenológicas alemanas que se autocomprenden en términos realistas. Afirmo la hipótesis de que es posible un diálogo productivo entre estas propuestas, basado en una comprensión mínima del realismo como fundamentación ontológica viable. Para esto, en primer lugar mostraré el sentido del actual resurgimiento del realismo en el contexto (...) de la ontología continental contemporánea, situando su recepción, crítica e integración a propósito del ámbito de la fenomenología y hermenéutica recientes. En segundo lugar, analizaré la propuesta de nuevo realismo, que está implicada en la ontología de campos de sentido de M. Gabriel. Y, en tercer lugar, reseñaré las propuestas de Günter Figal, Anton Friedrich Koch y Tobias Keiling en su fundamento realista. Mediante este trabajo comparativo, concluiré afirmando que el diálogo entre ambas corrientes comparte una comprensión realista no reductiva a la cuestión del mundo exterior, que le permite entenderlo como búsqueda de cierto criterio de objetividad para lo que aparece sensiblemente con sentido, con el propósito de esclarecer por qué las cosas reales son dependientes de la interpretación (interpretables en general), pero independientes de interpretaciones individuales. Building on the groundbreaking research of Irreducible Mind and Beyond Physicalism, Edward Kelly and Paul Marshall gather a cohort of leading scholars to address the most recent advances in the psychology of consciousness.

In this paper, I shall defend two main claims. First, Friedman’s famous paper “On the methodology of positive economics” (“F53”) cannot be properly understood without taking into account the influence of three authors who are neither cited nor mentioned in the paper: Max Weber, Frank Knight, and Karl Popper. I shall trace both their substantive influence on F53 and the historical route by which this influence took place. Once one has understood these ingredients, especially Weber’s ideal types, many of F53’s (...) astonishing sentences like “the more significant the theory, the more unrealistic the assumptions”, make good sense. Second, I shall claim that the much-discussed question whether Friedman’s essay espouses an instrumentalist or a realist position, is the wrong question to be asked. I shall illustrate that by a comparison with examples from physics in which also unrealistic assumptions are made. Also there, the question whether these assumptions are indicators of instrumentalism or realism is not appropriate. Cleared from these misunderstandings, F53 presents itself as an interesting and reasonable but much less controversial contribution to the methodology of economics. (shrink)

In the fourth Immanuel Kant Lecture, Quine summons the specter of Kant’s Ding an sich, the thing in itself. Clearly antithetical to his naturalism, Quine quickly dismisses it as having feet of clay. Despite this short shrift, it is worth examining what he did say about the Ding an sich—in the Kant Lectures, in “Things and Their Place in Theories”, and in “Structure and Nature”. I offer a critical reading of these passages in the context of Quine’s proxy functions, ontological (...) relativity, and structure. I argue that Quine uses the Ding an sich as a foil for his anti-metaphysical, deflationary structuralism—a view that grounds objectivity in true statements, without any transcendental notion of objects, without the Ding an sich. Many philosophers maintain that there is a distinction between acts that the agent plays an active role in producing, and acts that issue from the agent in a more passive fashion. According to the standard account, we can make sense of this distinction by maintaining that reflective or deliberative acts are paradigmatic cases of an agent’s playing an active role in the production of action. This chapter argues that this standard account is mistaken. Reflective or deliberative actions will seem to (...) be active only if we conflate three claims: that choice causes action, that motives do not determine choice, and that reflection suspends the effects of motives. The chapter argues that while and are true, is false. Further, is needed to support the claim that reflective acts are active. Given the falsity of, the chapter shows that reflective acts are not necessarily more active than unreflective ones. The chapter closes by suggesting a new model of agential activity. (shrink)

This paper deals with the following question: What features of modern natural science are responsible for the fact that, of all forms of science, this form is technologically exploitable? The three notions: concept of nature, epistemic ideal, and experiment, suggest the most important components of my answer. I will argue, first, that only the peculiar interplay of the modern concept of nature with an epistemic ideal attuned to it can cast experiment in the specific, highly central role it plays in (...) the pursuit of knowledge about nature. Despite clinical evidence of drug superiority, therapeutic modalities, like combination immunotherapy, are mostly considered cost-ineffective due to their high costs per life year(s) gained. This paper, taking an ethical stand, reevaluates the standard cost-effectiveness analysis with that of the more recent justice-enhanced methods and concludes by pointing out the shortcomings of the current methodologies.
